These Terms & Conditions (“Terms”) govern the access to and use of services provided by CB Caters (hereinafter referred to as “CB Caters”, “we”, “us”, or “our”), a luxury gourmet catering vertical of Chai Break.

By submitting an enquiry, confirming a booking, making a payment, or availing our catering services, you (“Client”, “Customer”, “you”, or “your”) agree to be bound by these Terms. If you do not agree, please refrain from using our services.

This document is an electronic record under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, and does not require physical or digital signatures.

 

 

1. Eligibility & Authority

  • You must be at least 18 years of age to enter into a binding agreement with CB Caters.
  • If you are booking services on behalf of an organization, company, or third party, you confirm that you have the authority to bind such entity to these Terms.

 

 

2. Scope of Services

CB Caters provides luxury gourmet catering services for events including but not limited to weddings, corporate events, private parties, destination events, conferences, and social gatherings.

Services may include food preparation, live counters, menu curation, service staff, and event-related catering support, as agreed in writing.

 

 

3. Enquiries, Quotations & Bookings

  • All enquiries are subject to availability and confirmation.
  • Quotations shared are indicative and valid only for the specified duration.
  • A booking is considered confirmed only upon receipt of an advance payment and written confirmation from CB Caters.
  • CB Caters reserves the right to decline any booking at its discretion.

 

 

4. Pricing, Payments & Taxes

  • Prices are exclusive or inclusive of applicable taxes as specified in the quotation.
  • Payment milestones, advance amounts, and balance payments must be made as per the agreed schedule.
  • Failure to make payments within the agreed timelines may result in cancellation of services.
  • Any additional requirements requested after confirmation may incur extra charges.

 

 

5. Cancellation & Refund Policy

  • Cancellation terms will be specified in the final agreement or quotation shared for the event.
  • Advance payments are non-refundable, unless explicitly agreed in writing.
  • No refunds will be issued for cancellations made close to the event date due to procurement and preparation commitments.
  • CB Caters reserves the right to cancel services due to non-payment or breach of these Terms.

 

 

6. Event Changes & Client Responsibilities

  • Final guest count, menu selections, and event details must be shared within the agreed timeline.
  • The Client is responsible for providing accurate event information including venue access, permissions, and utilities (electricity, water, space for setup).
  • CB Caters shall not be responsible for delays or issues caused due to venue restrictions or third-party vendors.

 

 

7. Food Safety, Allergies & Consumption

  • While CB Caters maintains high standards of hygiene and food safety, we do not guarantee an allergen-free environment.
  • Clients must inform us in advance of any allergies or dietary restrictions.
  • CB Caters shall not be held liable for reactions arising from undisclosed allergies or post-service food handling.

 

 

8. Alcohol Service (If Applicable)

  • Alcohol service, where provided, shall strictly comply with local excise and licensing laws.
  • Necessary permits, licenses, and approvals shall be the responsibility of the Client unless otherwise agreed.
  • CB Caters reserves the right to refuse alcohol service in case of legal or safety concerns.

 

 

9. Intellectual Property & Branding

All menus, concepts, visuals, designs, brand elements, and service formats developed by CB Caters remain our intellectual property and may not be copied or reused without prior written consent.

 

 

10. Limitation of Liability

CB Caters shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Losses arising due to third-party vendors, venue issues, or force majeure events
  • Any claims beyond the total value of the services provided

 

 

11. Force Majeure

CB Caters shall not be held responsible for failure or delay in performance due to events beyond reasonable control, including natural disasters, pandemics, government restrictions, strikes, or power failures.

 

 

12. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as outlined therein.

 

 

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
